For North Carolina Home Buyers & Sellers

What They Won’t Tell You: How to Save Money on Your North Carolina Home Purchase

Buying a home in North Carolina is a big step, and one of your closing costs is a line you can influence. North Carolina is an Attorney-closing state, so a licensed Closing Attorney oversees your closing, and you can still request the Signing Agent you want. Most buyers and sellers never realize they can also request their own Notary Signing Agent - here’s what that means and how to do it.

Your Signing Agent Is a Service You Can Shop For

Notaries who conduct real estate closings are called Notary Signing Agents. In most transactions, your Closing Attorney assigns the signing service - usually whoever they already work with. What most buyers and sellers don’t realize is that the Signing Agent fee is listed on your Closing Disclosure as a service you can shop for - and requesting a specific agent is usually all it takes.

One important caveat: your lender’s instructions govern the transaction. Some lenders require or pre-approve specific signing services, and when that’s the case, their requirement takes precedence. But in most standard residential transactions, the choice of Signing Agent belongs to your Closing Attorney - not the lender - and a simple request from you moves it.

Closing Attorneys aren’t doing anything wrong by defaulting to a familiar service. They’re managing dozens of files at once. It just means the choice quietly goes to whoever they’re used to - which may not be who gives you the best experience or the most competitive price.

The Signing Agent fee is a settlement service cost - it shows up on your Closing Disclosure and is paid after closing as part of your closing funds, not directly out of pocket at the signing table. Our North Carolina rate for a Buyer’s or Refinance signing is $175, all-in, the same rate we quote the professionals directly. Every package and add-on is on our full pricing page.

If your Closing Attorney is wondering whether working with us means extra steps for their team - it doesn’t. Our order platform integrates directly with the title production software they’re already using, including Qualia, ResWare, SoftPro 360, RamQuest, E-Closing, Closer’s Choice, LandTech, TitleDesktop, and AccuTitle. Orders come in through their existing system, status updates flow back automatically, and nothing changes about their workflow. We fit into the process they already have.

What to say: Tell your Closing Attorney, “We want Gold Coast Notary for our signing,” and have them reach out to orders@goldcoastnotary.co or call us at (323) 220-3526. We coordinate directly with their office on their timeline - no extra work on their end.

What Federal Law Says About Your Closing Costs

Two pieces of federal law are directly relevant to this:

  • RESPA Section 8 (Real Estate Settlement Procedures Act) prohibits kickbacks and undisclosed referral fees between settlement service providers. Signing agent fees are settlement services under RESPA. Any arrangement where a signing service compensates an escrow or Title Officer for steering business their way is a federal violation.
  • Your Closing Disclosure - the federally required closing summary your lender provides before closing - lists the signing/notary fee under “Services You Can Shop For.” That language comes directly from the Consumer Financial Protection Bureau’s disclosure rules. It means exactly what it says: you are permitted to shop for and select your own provider for this service. The CFPB explains this directly on their website.

This consumer right is recognized industry-wide. The National Notary Association certifies and credentials Notary Signing Agents specifically for real estate closings, and reputable escrow and Title Companies will accommodate a consumer’s request for a specific signing service when lender instructions permit it.

Gold Coast Notary is a proud member of both the National Notary Association and the American Land Title Association (ALTA) - the two primary professional bodies governing Notary Signing Agents and the title industry, respectively. Our notaries carry individual NNA certification, pass annual background screenings, and hold their own Errors & Omissions insurance. ALTA membership means our real estate closing services are built to the standards title and Escrow Companies expect from a trusted signing partner. When you ask for us by name, you can trust we’ll get your closing to the finish line - on time, done right.

Note: This page describes how the Signing Agent selection process generally works in residential real estate transactions. It is general information, not legal advice. For questions about your specific transaction, refer to your Closing Disclosure, speak with your Closing Attorney, or visit the CFPB’s consumer resources at consumerfinance.gov/owning-a-home.

North Carolina Closings

How Closings Work in North Carolina, and Where You Save

In North Carolina, a licensed Closing Attorney supervises the closing and the disbursement of funds. The Attorney does not have to personally notarize every page, and routinely uses a Notary Signing Agent for the signing itself, particularly for out-of-town Sellers or borrowers who cannot attend in person. Ask the Closing Attorney's office to use Gold Coast Notary, and you get a professional signing that keeps your closing on schedule anywhere in the state.

North Carolina has been one of the biggest relocation destinations in the country, with banking in Charlotte and research jobs in the Triangle pulling Buyers in from everywhere. A lot of those closings involve a party signing from out of state, so choosing your own Signing Agent gives you a professional who handles a mail-away or in-person signing cleanly while the Closing Attorney runs the rest.

We coordinate signings across North Carolina - including Charlotte, Raleigh, Greensboro, Durham, Winston-Salem, and Asheville - and out to the smaller communities in between. Wherever your closing table is, we can get a vetted Signing Agent to it.

North Carolina tip: From Charlotte to the coast, ask the Closing Attorney's office early who conducts your signing. Naming Gold Coast Notary up front helps you avoid a last-minute scramble and protects your move-in.

Questions & Answers

Choosing Your Own North Carolina Signing Agent - FAQ

Yes. The Attorney supervises the closing and the funds but routinely uses a Notary Signing Agent for the signing itself. Ask the Attorney's office to use Gold Coast Notary for that step.

Yes. We conduct the signing wherever you are, then return the executed package to the Closing Attorney by FedEx or UPS, with courier available for funding-deadline files.

Yes. We coordinate signings statewide, from Charlotte and the Triangle to Greensboro, Winston-Salem, and Asheville.

In most standard residential transactions, yes - but with one important caveat. Your Closing Attorney assigns the signing service, and a direct request from you will typically be accommodated. However, your lender's instructions govern: some lenders require or pre-approve specific signing services, and that takes precedence over any consumer request. If the Signing Agent fee appears on your Loan Estimate under Section C ("Services You Can Shop For"), you have formal authority under federal TRID rules to select your own provider. Check your Loan Estimate first - then make the request to your Closing Attorney.

It's not an attempt to hide anything - Closing Attorneys are managing dozens of files at once and use whatever signing service they're used to working with, often out of habit or convenience. They're not required to shop signing services on your behalf, so unless you ask, you'll simply get their default.

Start by checking your Loan Estimate. Under federal TRID rules (12 CFR §1026.19), if the signing or notary fee appears in Section C - “Services You Can Shop For” - you have a statutory right to choose your own provider. The CFPB explains this consumer right directly at consumerfinance.gov.

In North Carolina, real estate closings are typically overseen by a licensed Closing Attorney who manages the settlement process and handles the disbursement of funds under state bar fiduciary rules. As the National Notary Association confirms, Notary Signing Agents are actively used in attorney closing states - the Closing Attorney engages an NSA to conduct the actual document signing, and consumers can request a specific NSA or signing service for that role. Additionally, RESPA Section 8 (12 U.S.C. §2607) prohibits any settlement service provider from paying or receiving fees, kickbacks, or anything of value in exchange for the referral of settlement service business - meaning any financial arrangement that steers closings toward a preferred signing service is a federal violation.

In practice, most hesitation from your Closing Attorney comes down to familiarity, not a genuine legal restriction. Gold Coast Notary integrates directly with Qualia, ResWare, SoftPro 360, RamQuest, E-Closing, Closer's Choice, LandTech, TitleDesktop, and AccuTitle - no new workflow required. We carry $2M in company E&O insurance, and every NSA we place is NNA-certified, annually background-screened, and individually insured. Contact us and we're happy to speak directly with your Closing Attorney to address any questions they have.
